Severance Pay 2026: When You Are Entitled and How Much You Get

3 min read

Quick answer: You get severance pay when your employer ends your employment for organisational or health reasons — the amount is, by years of service, between one and four times your average monthly earnings on notice (Section 76 of the Labour Code). On termination by agreement it is one level higher. Below you will find a table and a worked example. Prepocty

When are you entitled to severance pay?

Entitlement arises if your employer ends your employment by notice or by agreement for organisational reasons (the post being abolished or moved, redundancy) or for health reasons. On notice, entitlement arises only after at least 2 years of service. Prepocty

If you resign yourself or are dismissed for a breach of duties, severance pay does not apply. Nor does it apply on termination during the probationary period.

How much is severance pay in 2026?

It depends on your years of service and on how the employment ends. On agreement, severance pay is one level higher than on notice:

Years of service Notice Termination agreement
less than 2 years
2 – 5 years
5 – 10 years
10 – 20 years
20 years and more

(× = average monthly earnings)

How is severance pay calculated (example)?

Severance pay is calculated from the average monthly earnings, established under Section 134 of the Labour Code, as a rule from the salary for the preceding calendar quarter. Example: an employee worked for 7 years with average earnings of €1,500. On notice for organisational reasons they get 2 times, that is €3,000; on agreement 3 times, that is €4,500. Will I get both severance pay and a notice period?

Yes. Since 2013 entitlement to severance pay and to a notice period have not excluded each other — on notice for reasons on the employer's side you get both. Financnekalkulacky

What is the difference between severance pay and a retirement allowance?

You get severance pay on losing your job for organisational or health reasons. A retirement allowance (Section 76a) is paid on first retiring and is, as a rule, one month's average earnings. Mojprijem

Resignation Letter Template 2026: Notice Periods and How to Give Notice

3 min read

Quick answer: In 2026 the notice period is at least one month and gets longer depending on how long you have been with the company and who is giving notice. If the employment lasted less than a year, it is 1 month; if it lasted at least a year, 2 months (Section 62 of the Labour Code). Below you will find an overview of the periods and a resignation letter template. PROFESIA.SK

What are the notice periods in 2026?

The length of the notice period depends on how long the employment has lasted and on who is giving notice. Here is an overview:

Situation Notice period
Probationary period none (ends immediately)
Employment < 1 year 1 month
Employee gives notice, ≥ 1 year 2 months Danovy-poradca
Employer gives notice, ≥ 1 year 2 months
Employer, organisational grounds, ≥ 5 years 3 months PROFESIA.SK

Important: as an employee you do not get a three-month period purely because of length of service — two months at most.

When does the notice period start running?

The notice period starts running on the first day of the calendar month following delivery of the notice. It ends on the last day of the relevant month, once the given period has elapsed. Mrp

So if you give notice on 10 March and have a two-month period, it runs from 1 April and the employment ends on 31 May.

How to write a resignation letter (template)

Notice must be in writing and delivered to the other party. Here is a simple template for an employee:

[Name Surname, address]

[Employer name, address]

In [city], on [date]

Subject: Notice of termination of employment

I hereby give notice of termination of the employment relationship concluded on [date]

for the position of [position], pursuant to Section 67 of the Labour Code.

The notice period starts running on the first day of the calendar month

following delivery of this notice.

Kind regards,

Can I end my job without a notice period?

Yes, by an agreement on termination of employment — if you agree in writing with your employer on a specific day, the notice period does not apply. Employment also ends without a notice period during the probationary period.

Watch out for the protected period: an employer may not give notice to, for example, a pregnant employee, during maternity or parental leave, or during sick leave. PROFESIA.SK

What to do after giving notice?

Do not wait until the last day to start looking for a new job. Articles such as how to find a job that fits and interview questions will help.
